1. Acceptance of Terms

By accessing or using Greeks ("the Service", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

We reserve the right to update these terms at any time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify users of material changes via email or a prominent notice on the platform.

2. Description of Service

Greeks is a financial analytics platform that provides options data including but not limited to: Greeks (Delta, Gamma, Vega, Theta), Gamma Exposure (GEX), Max Pain, Unusual Options Flow, and Expected Move calculations. The Service is provided via a web interface and REST/WebSocket API.

Access to certain features is gated by subscription plan (Free, Trader, Pro, Institutional). Plan features and pricing are described at /pricing and may change with notice.

3. Not Financial Advice

The information provided by Greeks is for informational and educational purposes only. Nothing on this platform constitutes financial, investment, trading, or legal advice.

Options trading involves significant risk of loss and is not appropriate for all investors. Past performance of any analytics, model, or indicator does not guarantee future results. You should consult a qualified financial advisor before making any investment decisions.

Greeks makes no representation or warranty that any data, analytics, or signals will result in profitable trades. You bear sole responsibility for your trading decisions.

4. User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Keep your API key(s) confidential and not share them with third parties
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these terms, engage in abuse, or are used for unauthorized purposes.

5. API Usage and Rate Limits

API access is subject to rate limits defined by your subscription plan. You agree not to:

• Circumvent rate limits through technical means (e.g., multiple accounts, rotating keys)
• Resell, redistribute, or sublicense API data to third parties without written permission
• Use the API to build a competing data service
• Scrape or bulk-download data beyond your plan's intended usage
• Use automated tools to access the web interface in place of the API

6. Subscriptions and Billing

Paid plans are billed monthly or annually as selected at checkout. By subscribing, you authorize us to charge your payment method on a recurring basis.

• Cancellation: You may cancel at any time. Your subscription remains active until the end of the current billing period.
• Refunds: We do not offer refunds for partial months. Refund requests for exceptional circumstances may be submitted to support.
• Plan changes: Upgrades take effect immediately. Downgrades take effect at the next billing cycle.
• Failed payments: If a payment fails, we will attempt to retry. Accounts with failed payments may be downgraded to the Free plan after a grace period.

Billing is processed securely by Stripe. Greeks does not store payment card information.

7. Prohibited Uses

You agree not to use the Service to:

• Violate any applicable law or regulation
• Engage in market manipulation or any activity that violates securities laws
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Transmit malware, spam, or any malicious code
• Harvest or collect user data from the platform

8. Intellectual Property

All content, software, algorithms, and analytics methodologies on the Service are the intellectual property of Greeks and are protected by applicable copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal or internal business purposes during your subscription period. This license does not include the right to redistribute, sublicense, or create derivative works.

9. Data Accuracy and Availability

We strive to provide accurate and timely data. However, we do not guarantee:

• The accuracy, completeness, or timeliness of any data or analytics
• Uninterrupted or error-free operation of the Service
• That the Service will be available at any specific time

The Service may experience downtime for maintenance, updates, or due to circumstances beyond our control. We are not liable for any losses resulting from data inaccuracies or service unavailability.

10. Limitation of Liability

To the maximum extent permitted by law, Greeks and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or financial losses resulting from:

• Your use of or inability to use the Service
• Any trading decisions made based on data from the Service
• Unauthorized access to your account or data
• Any errors, inaccuracies, or omissions in the data provided

Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Greeks and its affiliates from any claims, losses, liabilities, damages, costs, and expenses (including legal fees) arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these terms or use of the Service shall be resolved through binding arbitration, except where prohibited by law.
